Types of Bail Under BNSS & CrPC
From 1 July 2024, criminal procedure in India is governed by the Bharatiya Nagarik Suraksha Sanhita (BNSS, 2023). Our chambers evaluate whether your case falls under the BNSS or earlier CrPC provisions.
Regular Bail
नियमित जमानतAfter an arrest, bail is sought from the Magistrate or Sessions Court, and from the High Court where needed. The Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 deals with this, mainly in Sections 480 and 483.
Anticipatory Bail
अग्रिम जमानतIf you expect to be arrested, you can ask the Sessions Court or High Court for protection in advance. This is Section 482 of the BNSS.
Suspension of Sentence & Bail
दोषसिद्धि के बाद जमानतWhen an appeal is filed, the sentence can sometimes be suspended and bail sought while the appeal is pending.
The BNSS replaced the Code of Criminal Procedure from 1 July 2024. Older cases can still be governed by the earlier law, so the first thing we check is which law applies to yours.
What to Do in the First 48 Hours
The first 48 hours following police action dictate the trajectory of a criminal matter. Adhering to constitutional safeguards avoids irreparable harm.
Get the FIR details. Note the FIR number, police station, date and the sections mentioned. Ask for a copy.
Don't sign anything you haven't read. That includes blank papers and statements written by someone else.
If someone is arrested, note the time. A person arrested must be produced before a Magistrate within 24 hours. Tell the family where they are held.
Keep every paper. Notices, memos, receipts, medical reports, court orders.
Don't delete chats, calls or files. It looks worse and can be used against you.
Speak to a lawyer before you give a detailed statement. What is said early is hard to take back.
Don't ignore a notice to appear. Talk to us first, then respond in the proper way.

Frequently Asked Questions
Answers regarding non-bailable offences, anticipatory bail timelines, police notices, and High Court filings.
01Can bail be granted in a non-bailable offence?
Yes, but it isn't automatic. The court looks at the seriousness of the allegation, the evidence, the person's background and the risk of interference with the case. Every application is judged on its facts.
02When should I apply for anticipatory bail?
When you have a genuine fear of arrest, usually after an FIR is registered or when the police or a complainant is threatening one. Speak to a lawyer early, because the choice of court and the way the application is prepared both matter.
03How long does it take to get bail?
It depends on the court, the offence, the case papers and the listing of the matter. We can give you a realistic idea after seeing your documents.
04I got a notice from the police. Should I go?
Don't ignore it. Speak to a lawyer first, so you know what you're being called for and how to respond.
05Do you handle bail applications in the High Court?
Yes. Our Gomti Nagar office is in the New High Court CSC Building, Vibhutikhand.
